In these terms, "the seller" or "we" means the business named above, and "the customer" or "you" means any natural person who orders on this website for purposes outside their trade or profession (consumer).
These terms govern every order placed in the online shop of the website www.comptoiraubrel.be. They complement the legal notice and privacy policy of the website. By ticking the box "I accept the terms of sale" before confirming an order, the customer declares having read them and accepting them without reservation. The applicable version is the one displayed on the website at the time of the order; it is kept with the order and is available on request.
The terms exist in English and, where applicable, in French and Dutch. In the event of a discrepancy, the version in the language of the order prevails.
Products are described and photographed with the greatest care. Photographs are not binding: slight differences in shade, size or finish may occur, in particular for handmade items or natural materials. Offers are valid as long as they are visible on the website and while stocks last. If an ordered item turns out to be unavailable, the customer is informed without delay and any amount paid for that item is refunded.
Prices are quoted in euros, all taxes included. Delivery or shipping costs are not included in the price of the items: they are displayed before the order is confirmed, according to the chosen handover method and the address. The total amount payable, costs included, is summarised before confirmation.
For foodstuffs, the list of allergens and, where applicable, the price per kilo or per litre are shown on the product page before purchase. For products sold by weight, the final price is calculated on the weight actually weighed and may differ slightly from the amount estimated at the time of the order; the difference is settled at handover or refunded.
The seller may offer gift cards, digital products (downloadable files) and products on quotation. The price of a product on quotation is communicated to the customer before any obligation to buy.
The following are never sold on this website: medicines, tobacco products and products containing CBD. No struck-through or "former" prices are displayed outside the rules that apply to price reduction announcements.
In the event of an obvious pricing error (a price clearly out of proportion to the value of the product), the seller may cancel the order and then refunds the customer in full.
Orders are placed online in a few steps: choice of items and quantities, choice of handover method, entry of contact details, complete summary (items, prices, costs, total), choice of payment method and confirmation. The customer can correct the order at every step before confirming it.
An acknowledgement of receipt is sent by email to the address provided as soon as the order is confirmed. The sale is concluded only upon receipt of payment or, for orders paid at handover, upon confirmation of the order by the seller. The seller may refuse an order for a legitimate reason: unavailability, manifestly abnormal order, previous unresolved dispute, address outside the areas served. The customer is informed and refunded where applicable.
An order awaiting payment that is not paid within the period stated at the time of the order is cancelled automatically and the items are put back on sale.
The number of items per order may be limited. Promotional codes cannot be combined unless stated otherwise and never apply to gift cards.
Offline payment, according to the options offered at the time of the order. Payment on collection: the customer pays in the shop when the order is handed over. Payment on delivery: the customer pays the courier when the order is handed over. Bank transfer: the seller's bank details and a structured reference specific to the order are shown in the summary and in the confirmation email; the order is reserved for the period stated at the time of the order and is processed only once payment has been received. A transfer without the structured reference may delay processing.
Online payment: payment is entrusted to a licensed payment service provider, on its secure page. The seller neither collects nor stores any card or bank account details. Accepted payment methods are shown on the payment page. If the payment fails, the order remains pending until the stated period expires and is then cancelled.
A gift card issued by the seller can be used in whole or in part to pay for an order, except to buy another gift card. The remaining balance can be used until the card's expiry date. A gift card is not refundable in cash and cannot be exchanged for money.
Payment is deemed made when the seller receives the funds. Items remain the property of the seller until the price has been paid in full.
The available handover methods are offered at the time of the order; they depend on the items, the address and the shop settings.
Collection on site: the customer chooses a day and a time slot from those offered. The order is kept available at the collection address stated at the time of the order. An order not collected within seven days of the agreed date, without word from the customer, may be cancelled; perishable goods not collected on the agreed date are not refunded.
Local delivery: the seller delivers in person in the areas (postcodes) stated at the time of the order, on the chosen day and within the chosen time slot. Delivery costs and the amount above which delivery is free, if any, are displayed before confirmation. The customer ensures that an adult can receive the order; if nobody is present, a second delivery attempt may be charged.
Shipping: parcels are entrusted to a carrier and shipped to the countries stated at the time of the order. Costs depend on the destination and the weight; they are displayed before confirmation. The shipping time is indicative; unless otherwise agreed, delivery takes place no later than thirty days after the sale is concluded. A tracking number is communicated as soon as the parcel is handed to the carrier, when available. The risk of loss or damage passes to the customer upon physical handover of the parcel. A damaged parcel or a missing item is reported to the seller as soon as possible, with photographs, so that a claim can be lodged with the carrier; the seller replaces or refunds.
Digital products: the download link is provided to the customer on their order page and in the confirmation email as soon as payment has been received. It remains valid for the stated period; the customer keeps a copy of the file.
Gift cards: the card code is provided to the buyer on their order page and in their receipt as soon as payment has been received. The card is valid for 24 months from its issue; after that period, the balance is lost.
In accordance with articles VI.47 and following of the Belgian Code of Economic Law, the customer has fourteen days to withdraw from an order placed at a distance, without giving any reason. The period runs from the day on which the customer, or a third party designated by the customer, takes physical possession of the last item of the order; for a digital product or a gift card, from the day the contract is concluded.
To exercise this right, the customer notifies the seller of the decision before the period expires, by email to the address given in section "The seller", using the form in section "Withdrawal form", or by any other unequivocal statement. The seller acknowledges receipt by email.
The customer returns or brings back the items to the seller without undue delay and no later than fourteen days after communicating the decision. The direct cost of returning the items is borne by the customer. Items are returned complete, in their original packaging where possible, and in a condition allowing them to be resold; the customer is liable only for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the items.
The seller refunds all payments received, standard delivery costs included, without undue delay and no later than fourteen days after being informed of the decision to withdraw; the seller may withhold the refund until the items have been received back or proof of shipment has been provided. The refund is made using the same means of payment as the order, unless the customer expressly agrees otherwise.
In accordance with article VI.53 of the Belgian Code of Economic Law, the right of withdrawal cannot be exercised for:
Where an exception applies to an item, it is stated on the product page and repeated before the order is confirmed.
The customer benefits from the two-year legal guarantee of conformity for consumer goods provided for in articles 1649bis and following of the former Belgian Civil Code, and from the legal guarantee applicable to digital content. The seller is liable for any lack of conformity that exists at the time of delivery and becomes apparent within two years; a defect that becomes apparent within that period is presumed to have existed at the time of delivery, unless this presumption is incompatible with the nature of the goods or of the defect. For second-hand goods, this period may be reduced to one year where agreed.
In the event of a lack of conformity, the customer is entitled to have the goods repaired or replaced free of charge within a reasonable time; if this is impossible or disproportionate, to an appropriate price reduction or to the cancellation of the sale. The customer informs the seller of the defect within two months of noticing it.
The guarantee does not cover normal wear and tear, nor damage resulting from improper use, lack of maintenance, modification or an accident occurring after delivery. It does not deprive the customer of the rights conferred by the guarantee against hidden defects.
Buying digital content (a photo, video, course, guide, audio file or other downloadable file) gives the customer a non-exclusive, non-transferable right of personal and private use. The seller, or the author from whom the seller holds the rights, remains the rights holder: the purchase does not assign any copyright.
The customer may not resell, redistribute, publish or share the file or its download link, in whole or in part, whether free of charge or not. Professional or commercial use (for a business, a client, advertising or a product for sale) is allowed only if the product page expressly provides for it, and within the limits it states.
Download links are personal. The number of downloads allowed and the validity period of the links are shown on the product page; after that, the link no longer works.
A defective, incomplete or unreadable file is replaced free of charge under the legal guarantee of conformity for digital content (section "Legal guarantee of conformity"): the customer reports it to the seller, quoting the order number. If replacement is impossible, the customer is entitled to a price reduction or a refund.
Prices include Belgian VAT for any buyer established in the European Union, within the limits of the European distance-selling threshold.
Any question or complaint is first addressed to the seller, by email or by telephone using the details in section "The seller", quoting the order number. The seller undertakes to reply as soon as possible and to seek an amicable solution.
If no solution is found, the customer may contact the Consumer Mediation Service (Service de Médiation pour le Consommateur / Consumentenombudsdienst), Boulevard du Roi Albert II 8, box 1, 1000 Brussels, Belgium, mediationconsommateur.be, which handles consumer disputes free of charge or refers them to the competent qualified entity.
The data provided when ordering (name, contact details, address, content of the order, any note) are processed by the seller, as data controller, to perform the sale, handle the handover, follow-up and invoicing, and meet legal obligations. They are processed on the seller's behalf by the shop's technical provider and, where applicable, by the payment service provider and the carrier, each for the part that concerns them. They are neither sold nor used for advertising purposes.
Identification data are anonymised after the period stated in the privacy policy; accounting records are kept for seven years as required by law. The customer has the right of access, rectification, erasure, restriction of processing and objection by writing to the email address given in section "The seller", and the right to lodge a complaint with the competent supervisory authority.
These terms and every sale concluded on this website are governed by Belgian law. Subject to the mandatory rules of jurisdiction protecting consumers, the Belgian courts have jurisdiction over any dispute not resolved amicably or through mediation.
Should any clause of these terms be declared void or unenforceable, the other clauses remain in force. The seller's failure to rely on a clause does not amount to a waiver of it. The seller may amend these terms at any time; orders in progress remain subject to the version accepted when they were confirmed.
The customer may use this model to exercise the right of withdrawal (it is not compulsory): copy it into an email to the seller, complete it and send it.
